“As the patient’s wife alleged that the death was caused by negligence on part of the doctor, the post-mortem on the body was performed in camera. Also, an expert committee from the Sassoon General Hospital submitted a report to us that the death was caused by alleged negligence in dealing with the complications that occurred during the first surgery. So, we have booked 11 doctors who were involved in the surgery under Section 304 (a) of Indian Penal Code for causing death by negligence,” said Inspector Sahebrao Bhapkar of the Wanworie police station.

    Testimonies of three relatives of global terrorist Dawood IbrahimKaskar were the CBI's trump card to secure the conviction of a gutkhabaron and two D-Company gang members in an organised crime case, agency officials said on Wednesday.

    Special Judge B D Shelke in Mumbai convicted the owner of Goa Gutka, J M Joshi, and D-Company gang members Jamiruddin Gulam Rasul Ansari and Farukh Mansuri under the Maharashtra Control of Organised Crime Act(MCOCA) and relevant sections of Indian Penal Code on Monday.

    They were sentenced to 10 years in prison for helping the UN-designated global terrorist set up plants to manufacture gutkha, a chewable concoction of tobacco and various nuts, in Pakistan, where the D-Company is holed up.

    Gutkha barons Joshi and Rasiklal Manikchand Dhariwal(now-deceased co-accused) had a monetary dispute following which they sought the help of Dawood Ibrahim to resolve it.

    The gangster, the mastermind of the 1993 Mumbai blasts case, in turn, sought their assistance to set up gutkha manufacturing units in Pakistan to open a new source of revenue for his organised criminal gang.

    The CBI filed the charge sheet in 2005 after a thorough investigation. The investigation officer examined three relatives of Dawood Ibrahim, who exposed the links between the convicts and the Dawood Ibrahim gang, D-Company operations, and monetary exchanges, among others.

    During the trial, the CBI presented 44 witnesses, including Dawood's wife Mehjabeen's uncle Salim Ibrahim Sheikh and Saud Yusuf Tungetkar and Shamim Iltefat Qureishi -- brothers-in-law of Anees Ibrahim alias Chota Sheth and Dawood Ibrahim.

    NEW DELHI: Gutka major Rasiklal Manikchand Dhariwal currently in Dubai though wanted by the CBI in a sensational Gutka-underworld nexus case has agreed to appear before the investigating agency on April 4 as Solicitor General Goolam E Vahanvati said the crime probe team would not execute the non-bailable warrant against Dhariwal till then.
    As the court raised a question mark on the NBW issued against a witness in the case, Vahanvati revealed that the warrant was issued against Manickchand for the purpose of his production in a court as there were several documents which indicate his involvement in the case.
    Dhariwal''s son Prakash Rasiklal Dhariwal who moved the apex court through Harish Salve Prakash challenged a Bombay High Court order refusing to stay the execution of NBW against his father.
    A Bench of Justices K G Balakrishnan and Tarun Chatterjee recorded Prakash''s undertaking that his father would appear before the CBI on April 4.
    The Bench also questioned as to how a NBW could be issued against Dhariwal, who till date has been shown as an witness in the case. "The warrant was issued under what provision of Criminal Procedure Code?'' asked the Bench , adding "Police has no power to issue warrants against a witness."
    "This means warrants can be issued against anybody," the Bench observed and added it could only be issued if he was an accused in a case.
    Vahanvati said there were certain documents which point out Manickchand''s involvement in the case.
    Dhariwal and Jagdish Joshi, owners of "Manikchand gutka" and "Goa gutka" respectively, had pleaded before the court that the Mumbai Crime Branch had summoned them for questioning but they had informed police about their inability to come to India from foreign countries at this juncture as their NRI status would be disturbed.
